The Site is operated by BDMK Enterprises, LLC d/b/a Clarity Commercial Real Estate (“Clarity CRE,” “we,” “us,” or “our”), a licensed commercial real estate brokerage based in Baltimore, Maryland.

By using this Site, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are under 18, you are not authorized to use this Site. We reserve the right to refuse service to anyone at any time.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CLARITY CRE AND ITS PRINCIPALS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Clarity CRE, BDMK Enterprises, LLC, and their respective principals, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or your violation of these Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Baltimore, Maryland.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the Effective Date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Limitation on Time to Bring Claims

Any cause of action or claim you may have arising out of or relating to these Terms or your use of the Site must be commenced within one (1) year after the cause of action accrues. After that period, such claim is permanently barred, regardless of any statute of limitations or other law to the contrary.

16. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be severed from these Terms. The remaining provisions of these Terms will continue in full force and effect.

17. Waiver

No failure or delay by Clarity CRE in exercising any right, remedy, power, or privilege under these Terms shall operate as a waiver thereof. No single or partial exercise of any right, remedy, power, or privilege shall preclude any other or further exercise thereof. A waiver of any breach or default under these Terms shall not be deemed a waiver of any subsequent breach or default.
